Changing your Name and/or Gender Marker
in Nevada

Nevada allows for name and gender marker changes to be obtained by way of a court order. The same court order can change both your legal name and the gender with which you identify. You may be worried about needing to provide medical documents to the court to allow you to change the gender listed on your birth certificate. Fortunately, Nevada law does not require any medical documentation to effectuate a gender marker change. This is a favorable difference from the majority of other states; the only requirement for making the change is an order from the court.

Nevada State Law Requirements

The State of Nevada lists these as the requirements for changing you name and gender marker in NRS 41.270 - 41.270:

  1. You must be at least 18 years old or you must be legally emancipated

  2. You must be a resident of Clark County, Nevada if you would like to make the change in the Las Vegas area.

  3. Any felony records must be disclosed to the Court

  4. Name changes cannot be obtained for the purpose of attempting to trick creditors (people you owe money).

If you meet these requirements, the next step would be to fill out the necessary forms and file them with the Court in your jurisdiction. Essentially, you will be petitioning the court to issue a court order approving the name and/ or gender marker changes you have indicated on your forms. It is important to note that there are special rules that apply if you are a minor or if you have a previous felony. However, the vast majority of these petitions are not challenged by a third party and the Court will grant them if no issues arise. After obtaining your order, you can submit it to Nevada Vital Statistics who will amend your birth certificate. Other legal documents can also be amended with the court order. Nevada allows for gender designations of “male", “female” and “X” on birth certificates and driver’s licenses. The process of petitioning the court can be confusing and it is commonly recommended that petitioners hire an attorney to help them through the process.
