Will Drafting
You’ve worked hard to get where you are today and your collected assets reflect that. Make sure that your belongings and your bank account find their way to the people and organizations you choose, not wrapped up in endless intestacy proceedings.
What is Intestacy?
Intestacy is the fancy legal term for the complex legal process set up by the State of Nevada to decide where your hard earned assets go when you die. When a person passes away without sufficient documentation to distribute their belongings, their estate becomes subject to the state’s intestate process. The unfortunate part of this situation is that it is left up to the state, not the deceased, to determine who receives what. Even more unfortunate is that in some rare cases, without a Will, part or all of a person’s estate can be allocated to the State itself.
How do I avoid Intestacy?
Instead of lining the government’s pockets or leaving your loved ones to pay a hefty sum to a probate attorney, make sure your wealth ends up where it belongs. The best way to avoid your estate ending up in intestacy is to have a legally sound estate plan. This includes having a Last Will and Testament drafted by an experienced attorney which lays out your estate as you would like to have it distributed.
Wills allow you to make specific gifts to your heirs, split your estate evenly amongst your named heirs, or a combination of the two. It seems simple, so why do you need an attorney? The problem that can send an estate into intestacy even if you’ve left instructions for after your death, is that a legal Will must comply with certain provisions of the Nevada Revised Statutes. Simply telling your loved ones what you would like done after your death is not enough to ensure that it happens. It must be written down and it must meet the requirements of Nevada law. Don’t leave your legacy up to chance. Prepare for someday today, and enjoy the peace of mind that comes with a professionally prepared Will.
